Abstract
This study explored the mistakes made by private sector employers in terminating employment contracts in Tanzania, with a focus on Gardaworld and SGA Security companies in Kinondoni Municipality. Three specific objectives guided the study: assessing training and awareness, identifying private sector termination mistakes, and determining alternative measures to reduce termination mistakes in private sectors within Kinondoni municipality. It employed two theoretical frameworks: the unjust dismissal theory, which advocates for employee protection and fair treatment, and the procedural justice theory, which emphasises the fairness of decision-making processes. The study utilised a case study design, focusing on Kinondoni Municipality with a sample size of 14 participants, including terminated employees, HR managers, and mediators from the Commission for Mediation and Arbitration (CMA). Data were
collected through in-depth interviews and documentary reviews. The study employed a thematic analysis method to analyse data. The findings revealed that employers, especially in the private sector, often lack an understanding of termination laws, leading to unlawful terminations. The study recommends the need for employers to improve documentation, enhance communication, and adhere to legal requirements to
avoid disputes. It recommends increased training for HR personnel on labour laws, the implementation of alternative dispute resolution mechanisms, and providing alternatives to termination, such as performance reviews and voluntary separation packages.
